Terms of Service
These Terms govern your use of Tokei.ID (watch-identifier.com), operated by MarioApps, LLC(“we,” “us”). By signing in or making a purchase you agree to these Terms. If you don't agree, please don't use the service.
1. The service
Tokei.IDis an AI-powered tool that identifies wristwatches from a photo and helps you keep a personal collection (“Vault”). Identifications are produced by third-party large language models and are best-effort estimates, not professional appraisals.
2. Eligibility
You must be at least 13 years old to use Tokei.ID. If you live somewhere with a higher minimum age for online services, you must meet that age.
3. Your account
You sign in with a Google account. You're responsible for keeping your Google credentials safe. We may suspend or terminate accounts that abuse the service, violate these Terms, or attempt to bypass our limits.
4. Free tier and Pro subscription
The free tier includes a lifetime limit of three (3) identifications and a Vault cap. Pro removes both limits.
Pro is sold as a recurring subscription (monthly or annual) processed by Stripe. By subscribing you authorize us, via Stripe, to charge your payment method on each billing cycle until you cancel.
Cancellation. You can cancel anytime from Profile → Manage subscription. Your Pro access continues until the end of the current billing period; we do not pro-rate refunds for partial periods.
Refunds. Outside of mandatory consumer-protection rights in your jurisdiction, all charges are non-refundable. If you believe you were charged in error, email support@watch-identifier.comwithin 14 days and we'll review it.
Price changes.We may change Pro pricing for future renewals. We'll give you reasonable notice (at least one billing cycle) before a price change takes effect.
5. Acceptable use
You agree not to:
- Use the service for any unlawful purpose.
- Attempt to bypass scan limits, App Check, or other technical safeguards.
- Scrape, harvest, or otherwise systematically extract data from the service.
- Upload content that infringes intellectual-property or privacy rights of others.
- Upload photographs of identifiable individuals without their consent.
- Resell, sublicense, or commercially exploit the service without our written permission.
6. Your content
You retain ownership of the photos and metadata you upload (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, process, and display Your Content solely for the purpose of providing the service to you (e.g. identifying the watch, showing it back to you in your Vault).
We will not use Your Content to train AI models, sell it, or share it with third parties beyond what is necessary to deliver the service (see our Privacy Policy for the list of sub-processors).
7. Identification disclaimer
AI identifications and market-value estimates are informational only. They are not appraisals, investment advice, or guarantees of authenticity. Do not rely on Tokei.ID as the sole basis for buying, selling, insuring, or authenticating a watch. Always confirm with a qualified watchmaker, dealer, or auction house before making any financial decision.
8. Our content
The Tokei.ID brand, website, code, design, and copy are owned by us or our licensors. You may not copy, redistribute, or create derivative works without our permission.
9. Disclaimers
Tokei.IDis provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to Tokei.ID is limited to the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or USD 100, whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages.
11. Termination
You may stop using the service at any time and delete your account from Profile → Delete account. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, governing law) will survive.
12. Changes
We may update these Terms from time to time. If we make a material change we'll update the “Effective” date and, where appropriate, notify you. Continued use of Tokei.ID after a change constitutes acceptance.
13. Governing law & disputes
These Terms are governed by the laws applicable at the registered place of business of MarioApps, LLC, without regard to conflict-of-laws rules. We'll always try to resolve issues directly first — email support@watch-identifier.com before escalating. Where local consumer-protection law gives you the right to bring a claim in your home jurisdiction, those rights are not waived.
